Terms and Conditions

1.      Service and Service Provider

 

1.1  Engagement of Service

 

The Pennsylvania National Mutual Casualty Insurance Company (hereinafter "Penn National Insurance") Short Code _______ (hereinafter "Short Code") allows users to authenticate themselves using a one-time passcode that is delivered to their phone in an SMS message. Any person that engages in the SMS services will be referred to hereinafter as the "user." Your use of SMS services constitutes your agreement to the SMS Terms and Conditions. Penn National Insurance may modify or cancel the SMS service or any of its features without notice. Penn National Insurance may also modify the SMS Terms and Conditions at any time and your continued use of SMS services following the effective date of any such changes shall constitute your acceptance of such changes.

 

1.2  Service Provider

Penn National Insurance is able to deliver messages to the following mobile phone carriers:

Carriers are not liable for delayed or undelivered messages.

1.3  Services

 

1.3.1        Multi-Factor Authentication

Penn National Insurance may utilize Multi-Factor Authentication ("MFA") in order to verify a user's identity during the set up and online account management. During the set up process, expect that Penn National Insurance may request your permission to send an SMS message to your mobile device to get started. Additionally, Penn National Insurance may leverage SMS messaging if you attempt to update or change your password.

1.3.2        SMS Messages

 

Penn National Insurance may utilize SMS messages to notify users about billing, payments, appointments, marketing, maintenance, service updates and surveys. Communications through our short code services occur on an opt-in basis on notification preferences users can set up using their account portal.

 

1.4  Charges

 

There are no charges for use of SMS services imposed by Penn National Insurance.  Users will incur only rate charges applicable under the user's agreement with his/her mobile phone service provider for use SMS services. Message and data rates may apply for any messages sent to you from us and to us from you.

 

2.      SMS Information

 

2.1  Opt-In Services

When you opt-in to each of the services, Penn National Insurance will send you an SMS message to confirm your signup.

2.2  Opt Out

You can cancel SMS services at any time. Just text "STOP" to _______ to opt-out. After you send the SMS message "STOP" to us, Penn National Insurance will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

2.3  Account Information

You will receive one SMS message if/when you begin an account, change a password or attempt to terminate your online account. Message frequency may vary. If you have questions about your text plan or data plan, please contact your wireless provider.

2.4  Restart Service

If you want to join again, just sign up as you did the first time and Penn National Insurance will start sending SMS messages to you.

2.5  Help with SMS services

If you need support, just text "HELP" to _______. If you need additional help, please call 1-800-766-2245 or email CustomerContactCenter@pnat.com. After you send the SMS message "HELP" to us, Penn National Insurance will respond with instructions on how to use our service as well as how to unsubscribe.

2.6  No Liability

Penn National Insurance is not liable for delayed or undelivered messages.

 

3.      User's Responsibilities

 

3.1  Wireless Service Requirement

Users are responsible for having and maintaining a wireless device that can connect to a mobile network capable of receiving SMS services.

3.2  User Solely Responsible for Agreement with Wireless Service Provider

Please note that Penn National Insurance has no control over the user's agreements with his/her wireless device service provider and is therefore not responsible for and will not be liable for any breach of the terms of such agreement or any mistake that may arise in the billing process.

3.3  Right to Use Wireless Device

User acknowledges that he/she is the owner of the wireless device or that he/she has the express consent of the owner of the wireless device used with SMS services.

3.4  Acceptance of Terms

By engaging SMS services using the Short Code ______, the user implicitly accepts the Terms and Conditions outlined in this document.

 

4.      Termination

4.1  Termination for Cause

Penn National Insurance may terminate SMS services at any time and with immediate effect where:

4.1.1. User is in breach of any of these Terms and Conditions; or

4.1.2 User is in breach of contract with his/her wireless service provider; or

4.1.3 Where Penn National Insurance is required to terminate by the wireless service provider or by law.

4.2  Termination for Convenience

Penn National Insurance may also unilaterally terminate SMS services at any time with or without cause.

 

5.      Disclaimer of Warranties and Limitation of Liability

Penn National SMS services and all information conveyed by them are provided to you on an "as-is" and "as available" basis, at your own risk to the fullest extent permitted under applicable law. To the fullest extent permitted under applicable law, Penn National Insurance disclaims all warranties, whether express or implied, including without limitation, any warranties of title, merchantability, non-infringement and fitness for a particular purpose and all warranties regarding security, currency, correctness, quality, accuracy, completeness, reliability, performance, timeliness, or continued availability. Penn National Insurance makes no representation or warranty that (i) SMS services will meet the user's needs, (ii) SMS services will be uninterrupted, timely, and secure or error free, or (iii) the messages that may be obtained from the use of the SMS services shall be reliable.

With regard to all SMS services provided by Penn National Insurance, users agree that Penn National Insurance disclaims and is not responsible or liable for any direct, indirect, or consequential loss or liability (including personal injury) resulting from any acts (or failures to act) of Penn National Insurance and/or its employees, including, but not limited to: (1) loss of data; (2) loss of software or hardware; (3) loss of business or business opportunity; (4) loss or liability resulting from access delays or access interruptions; (5) loss or liability resulting from computer viruses; (6) loss or liability resulting from data non-delivery or data miss-delivery; (7) any other loss or liability resulting from the negligent acts and/or omissions of Penn National Insurance or its vendors or partners; (8) loss and liability resulting from any errors, omissions, or misstatements in any and all information, goods, or services obtained on or through the SMS services; (9) loss or liability resulting from partial or total loss of SMS services; (10) loss or liability of any kind or nature whatsoever in any way related to third party charges, including wireless service provider or telephone company or other line charges; (11) personal injury, personal or business losses or interruptions, emotional injury, and/or consequential damages; and, (12) loss or liability resulting from acts of God.

 

6.      Entire Agreement

These Terms and Conditions set out the entirety of the agreement between the user and Penn National Insurance. Penn National insurance may modify the Terms and Conditions at any time.

 

7.      Governing Law

These Terms and Conditions will be governed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to choice of law principles. User hereby irrevocably submits to the original jurisdiction of those State or Federal courts located within the County of Dauphin, Commonwealth of Pennsylvania, with regard to any controversy arising out of, relating to, or in any way concerning these Terms and Conditions and irrevocably agrees to be bound by any final judgement rendered thereby from which no appeal has been taken or is available. User irrevocably waives any objection (including without limitation any objection of the laying of venue or based on the grounds of forum non convenience) which it may now or hereafter have to the bringing of any action or proceeding with respect to these Terms and Conditions in the jurisdiction set forth above.

Penn National Insurance SMS Short Code application and the associated Penn National Insurance website available at https://www.pennnationalinsurance.com/ ("Penn National SMS services") are owned and operated by Penn National Insurance. This Penn National Insurance SMS Short Code privacy policy ("Privacy Policy") is intended to inform you of our policies and practices regarding the collection, use and disclosure of any information you submit to us through Penn National SMS services.

Collection of Information

We will collect your mobile phone number and other personally identifiable information that you voluntarily provide to us ("Personal Information") in order to participate in the Penn National SMS services. Personal Information is information such as your name, e-mail address, user ID number, and other non-public information. You may refuse to provide your Personal Information, and this may lead to your inability to participate in Penn National SMS services.

Mobile devices may collect different information than what is collected by computers used to access our website.  When connecting to our website using a mobile device that provides Internet access, if the mobile device service provider uniquely identifies the device, Penn National Insurance may receive this information. 

Personal Information

Personal Information is collected in order to participate in Penn National SMS services pursuant to the Terms and Conditions for Penn National SMS services. Penn National Insurance may use your Personal Information for the following purposes: to administer and improve the programs and/or related services including SMS services; to provide Internet and/or mobile security; and to meet legal requirements. Penn National Insurance, its affiliates and service providers may have access to your Personal Information and any information you enter through Penn National SMS services. Penn National Insurance may work with affiliated organizations to perform certain functions on our behalf, such as managing data or processing information. These third parties will have access to your Personal Information only to the extent necessary to perform these specific functions and may not use it for any other purpose.

No Collection of Information from Children

Penn National SMS services are not intended for users under the age of 18, nor does Penn National Insurance knowingly collect or retain information from children under the age of 13.

User Consent

By accessing or otherwise using Penn National SMS services, you agree to the terms and conditions of this Privacy Policy and the associated Terms and Conditions and you expressly consent to the processing of your Personal Information according to this Privacy Policy. Your Personal Information can only be processed in the United States.

Use and Disclosure of Information

Except as otherwise stated in this Privacy Policy, we do not generally sell, trade, rent, or share the Personal Information that we collect with third parties, unless you ask or authorize us to do so.

We may provide your Personal Information to third-party service providers who work on behalf of or with us to provide some of the services and features of Penn National SMS services and to help us communicate with you. Despite your indicated email preferences, we may send you administrative emails regarding Penn National SMS services, including, for example, notices of updates to our Privacy Policy if we choose to provide such notices to you in this manner.
